Terms of Service

1. Agreement

By using facefollow.me and any of its products ("the Service"), you agree to these Terms of Service. If you do not agree, you must not use the Service.

2. Products & Services

The Service currently includes the following products:

• FaceFollow Widgets — Interactive face widgets generated from uploaded photographs
• Handwriting Fonts — Custom fonts generated from uploaded handwriting samples
• Drawing to Toy — Scene images, toy images, and 3D models (GLB/STL) generated from uploaded drawings or sketches

We may add, modify, or discontinue products at any time. Pricing is listed at the point of purchase and is subject to change.

3. Eligibility & User Affirmations

Age Requirements

You must be 18 or older to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age. This Service is not directed to children under 13, and we do not knowingly collect information from children under 13. The Drawing to Toy product is designed for use by parents and guardians — children should not use the Service directly.

Content Ownership & Consent

By uploading content, you affirm that you own it or have permission to use it. For photographs of people, you must have consent from any depicted individuals for AI processing of their likeness. For children's artwork, the uploading parent or guardian must have authority to submit the content.

Facial Image Processing Consent

By uploading a photograph to the FaceFollow Widget product, you expressly consent to the AI processing of facial features in that photograph for the sole purpose of generating your requested widget. You acknowledge that:

• Your photograph will be transmitted to third-party AI services for processing
• The AI will analyze and manipulate facial features (such as gaze direction and expression) to generate output images
• This processing does not create a biometric identifier, faceprint, or facial recognition template
• This processing is not used to identify, verify, or authenticate any individual
• Your original uploaded photograph is automatically deleted within 24 hours of processing
• Only the generated output (sprite sheet) is retained

You may withdraw this consent at any time by contacting us, at which point we will delete any stored content associated with your order.

Content Restrictions

Uploaded content must NOT contain:

• Nudity or sexually explicit content
• Content depicting minors inappropriately
• Violent or disturbing imagery
• Hateful or discriminatory content
• Illegal content

We use automated content moderation to screen uploads. Automated screening is not guaranteed to catch all violations, and we reserve the right to remove content at our discretion.

Prohibited Uses

You may NOT use this Service for:

• Creating deceptive deepfakes
• Harassment or intimidation
• Impersonation or fraud
• Political disinformation
• Any illegal purpose

4. Intellectual Property

• You retain ownership of your original uploaded content (photos, handwriting samples, drawings)
• You grant us a limited, non-exclusive license to process your uploads through our AI systems solely for the purpose of generating your requested output
• Upon payment, you own the generated content (widget sprites, font files, images, 3D models)
• The platform, algorithms, embed code, and website remain our property

5. Payment & Refunds

• Payments are processed securely via Stripe. We do not store your payment card details
• By purchasing, you consent to immediate delivery of digital content and acknowledge that you waive your right of withdrawal once processing begins
• If generation fails due to a technical error on our end, you may request a refund or retry generation at no additional cost
• Refunds are not provided for dissatisfaction with AI output quality, as results are experimental and vary

6. 3D Models & Physical Printing

The Drawing to Toy product generates 3D model files (GLB and STL formats). Regarding these models:

• 3D printability is not guaranteed — Generated models are experimental and may not be suitable for all 3D printers, materials, or printing methods
• Third-party print services — We may link to third-party 3D printing services for your convenience. We are not affiliated with, responsible for, or liable for any transactions, print quality, or issues with these services
• Physical safety — If you 3D print a model, you are solely responsible for ensuring the physical object is safe and appropriate for its intended use, including use by children
• No product liability — We are not liable for any injury, damage, or harm resulting from 3D printed objects made from our generated models

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We are not liable for:

• AI output quality, accuracy, or suitability
• Misuse of generated content
• Issues with third-party services (AI processing, printing, hosting, payment processing)
• Indirect, incidental, special, consequential, or punitive damages
• In no event shall our total liability exceed the amount you paid for the specific product giving rise to the claim

8. Indemnification

You agree to indemnify, defend, and hold harmless facefollow.me, its operators, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, uploaded content, generated output, physical objects produced from generated models, or violation of these Terms.

9. Dispute Resolution & Arbitration

Please read this section carefully. It affects your legal rights.

You and facefollow.me agree to resolve any disputes arising out of or relating to these Terms or the Service through binding individual arbitration, rather than in court, except that either party may bring claims in small claims court if eligible.

• Arbitration will be conducted by a neutral arbitrator under the rules of JAMS or another mutually agreed arbitration provider
• Arbitration will take place in the State of California or, at your election, via telephone or video conference
• Class action waiver: All claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding
• The arbitrator may award the same relief that a court could, but only to the individual party seeking relief
• If this arbitration agreement is found unenforceable, the dispute shall be resolved in the courts of the State of California

Opt-out: You may opt out of this arbitration agreement by sending written notice to support@facefollow.me within 30 days of first using the Service. Your notice must include your name, email address, and a clear statement that you wish to opt out of arbitration.

10. Third-Party Services

We use third-party services for AI processing, 3D model generation, content moderation, hosting, payments, and email delivery. Your use is also subject to their terms. See our Privacy Policy for details on specific service categories.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be noted by updating the effective date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
